What Happens After Filing of Reply to Examination Report

After filing a reply to an examination report, the Trademark Registry will review the response and either accept the trademark application for publication or issue a hearing notice if there are still objections to the application.

If the Trademark Registry is satisfied with the response and finds no further objections, the trademark will be accepted for publication in the Trademark Journal.

Once published in the journal, third parties will have the opportunity to oppose the registration of the trademark within a specified period.

If the Trademark Registry is not satisfied with the response or finds further objections, a hearing notice will be issued to the applicant.

The applicant will be required to attend a hearing and present arguments in support of the trademark application. After the hearing, the Trademark Registry will issue a final decision, either accepting or rejecting the application for registration.

It is important to note that the process of responding to a trademark examination report can be complex, and it is advisable to seek the assistance of a trademark attorney or agent to ensure the best possible outcome for your trademark application.
